The Linux Foundation THRIVE-ONE subscription plan grants you access to:
- Any self-paced e-learning course hosted on the Linux Foundation platform, for the subscription term length (the “Term”) set forth at the time of purchase. If you purchase a monthly plan, your Term is one month from the date of purchase, whereas the purchase of an annual plan results in a one year Term.
- (Annual subscription only) Access to SkillCred exams which allows for one (1) attempt at each SkillCred exam during your first year.
- By purchasing a THRIVE-ONE Annual or Monthly subscription, you also agree to the terms and conditions included here (link) and included below.
Exclusions: The following content is not available through THRIVE- Certifications, instructor-led courses; and FINOPS courses, bundles and certs.
You understand and agree that at the end of each applicable Term we will automatically process your payment, and renew your subscription plan for a period equal to the Term. SkillCred exams are only available for a period of one-year so any and all SkillCred exams must be taken during the first, one-year period.
You may request a Subscription* Refund if BOTH the following conditions are met:
(a) Your subscription purchase was less than three (3) business days ago AND
(b) You have not yet scheduled the certification exam and you have not completed any eLearning course or SkillCred Exam.
If you are eligible for a refund (per the Exam Refund Policy), please login with your LF Account to https://trainingsupport.linuxfoundation.org and select your request type from the categories provided.
Subscriptions can be canceled at any time during the Term.
There will be no refunds if you cancel prior to the end of your subscription term.
For example, if you have a monthly subscription, renewing on the 1st of the month, and you cancel on the 15th of a month, you will continue to have access until the end of the month and not receive a prorated refund for half of the month.
*If your subscription was purchased as a “bundle” with a Certification exam – the Certification exam will also be canceled and refunded.
Personal vs Corporate Application of These Terms
If the domain name of the contact email for the subscription is one used by an employer to issue email addresses to employees, then the person agreeing to these terms shall be deemed to be acting on behalf of their employer, and such employer is the other party to the contract formed by these terms (i.e., the employer is the “you” used in these terms). If the domain name for the contact email is one typically used for personal email accounts, then you are entering into these terms in your individual capacity.
Intellectual Property
Thrive training materials are protected by copyright and other intellectual property rights, and, other than open source licensed materials incorporated therein, are provided only for use in the form in which they are provided. Open source licensed materials incorporated in the training materials may have other copyright holders and is used pursuant to the applicable open source license.
Limitation of Liability
Neither party shall be liable for (1) any indirect, special, consequential, exemplary or punitive damages, or (2) any damages in an amount exceeding the subscription amount paid by you. The foregoing limitations of liability are an essential basis of the decision of provider to offer the engagements, and shall apply regardless of the legal theory upon which damages may be claimed, regardless of whether a party knew or should have known of the possibility of such damages, and regardless of whether the foregoing limitations of liability cause any remedy to fail in its essential purpose.
Miscellaneous
Either Party will be excused for any failure or delay in its performance under due to any cause beyond its reasonable control. If any provision of the Agreement, or any portion thereof, is held to be invalid and unenforceable, then the remainder of the Agreement shall nevertheless remain in full force and effect. This Agreement shall be governed exclusively by the laws of the State of Delaware, without reference to its principles of conflicts of law, the 1980 United Nations Conventions on Contracts for the International Sale of Goods, or other international laws. If you are a US resident (in the case of a corporate entity, headquartered in the US) the Parties consent to the personal and exclusive jurisdiction of the federal and state courts in Delaware. Otherwise, any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be determined by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules; the seat of arbitration shall be Delaware; and the parties agree to use remote video- or tele-conferencing for all hearings.
